Terms and Conditions of the Service to the Partners

Commission Only Model

Introduction

This agreement stipulates the relationship between the Client, from hereon called “The Partner” and the supplier, from hereon called “ShortStayApartment.com”, of the Commission Only Model service from hereon called “Commission Only”. The Partner agrees to respect the Terms and Conditions of the service contained within this document in relation to the service provided by the website www.shortstayapartment.com.

The term “ShortStayApartment.com” or “Us” refers to the owner of the website www.shortstayapartment.com. The term “Partner” or “You” refers to the owner or administrator of the apartments/villas published on the website www.shortstayapartment.com. The term “User” refers to the Users of the website www.shortstayapartment.com.

Conditions of Service

ShortStayApartment.com offers to supply to the Partner the following service:
ShortStayApartment.com will publish your apartments, or the apartments of which you are the administrator, for an unlimited period of time without any form of fixed compensation.

Only when a booking enquiry passed by us is confirmed to the user by you, must you pay a commission on the final amount agreed for the stay.

The service proceeds as follows:

  1. The users of ShortStayApartment.com choose one of your apartments from our listings and complete the related Booking Enquiry Form on our website.
  2. ShortStayApartment.com will automatically forward this Booking Enquiry to you, by email, to which you must respond through the ShortStayApartment.com Backoffice (administration system).
  3. You will receive the name of the apartment requested, the check-in date of the required stay, the number of nights required, the number of people in the group, a booking enquiry reference number, and also any comments added by the User. From the moment you receive this information you will be responsible to inform the User, through the Backoffice, of the availability or non availability of the requested apartment.
  4. According to your availability calendar, and in the case that you do have availability, you must inform the User about the total cost of the stay.
    In case you do not have availability, you can offer one of the apartments you have listed or other dates as an alternative, or you must decline the booking stating that there was no availability for the dates requested. Your response will be automatically sent to the User by ShortStayApartment.com with a link to book the apartment offered.
  5. If the User decides to reserve it, they will fill in the online payment form and a notification of a booking confirmation request will be automatically sent to you.
  6. You will be responsible to finalize the booking through the Backoffice and proceed to charging the User's credit card according to your pre-payment policy. For security reasons all credit card details are deleted from our database as soon as you finalize the booking.
  7. A confirmation email will be automatically sent by ShortStayApartment.com to both the User and to you. At this point both you and the User have each other's contact details. You will see the User's contact details in the Backoffice and the User will see yours on the confirmation email. It is your responsibility to contact the user for any special agreements on arrival/departure or any further communication.

Terms and Conditions of Payment

Cost of Service

The commission fee that the Partner agrees to pay to ShortStayApartment.com corresponds to a percentage agreed between the two parties, on the total amount of the sum due paid by the user for the accommodation reservation.

Furthermore, the Partner also agrees to pay the Commission Fee on all subsequent bookings made by a User whose details were originally supplied by the ShortStayApartment.com service.

ShortStayApartment.com is not entitled to receive commissions on the booking enquiries that did not become confirmed by the Partner.

Enquiry Management and Commission Calculation

Every booking enquiry that the Partner receives from ShortStayApartment.com is stored in the “Backoffice” (ShortStayApartment.com administration system), to which the client has access with the username and password that we supply upon confirmation of Sign Up.

Every time ShortStayApartment.com sends a booking enquiry to the Partner, the Partner must confirm or decline it within 1 working day from its receipt. With this system, both parties have access to the list of enquiries with their related status of either “confirmed” or “declined”. On this list, ShortStayApartment.com calculates the base amount from which derives the amount due as the Commission Fee.

Booking Cancellations

In case of cancellations of bookings on behalf of ShortStayApartment.com’s Users, the Partner is free to apply its own no-show and cancellation policy. ShortStayApartment.com needs to be informed about the cancellation by the Partner within 3 days from the cancellation.

ShortStayApartment.com will not be due any commission on cancelled bookings when these take place due to our Users’ request. Should the Partner not inform ShortStayApartment.com about the cancellation of bookings within the stated 3 days, these will be considered confirmed and the Partner will owe the agreed commission on them.

Users can decide to cancel their bookings through ShorStayApartment.com. In this case you are free to apply your usual cancellation policy, which has been previously inserted in your listing account and which is accepted by the Users upon booking confirmation. ShortStayApartment.com will notify you about the cancellation and you will be responsible for any claims of cancellation fees with the users. Our commission will be subsequently nullified. 

Invoicing

ShortStayApartment.com will generate an online invoice for the amount of the commissions owed by the Partner once a month, between the 1st and 5th of each month. This commission amount is calculated on the total sum of the bookings confirmed by the Partner during the previous month. ShortStayApartment.com is therefore due the commission agreed after the Users have checked-in. The Partner will be notified with a message in the Backoffice, where he/she can proceed to settle the payment online and print the invoice. Each invoice must be paid within 15 days from the date of the invoice. 

Method of Payment

ShortStayApartment.com accepts payment of the balance by Credit Card or PayPal through the Backoffice, or by Bank Transfer to the bank account that will be specified on the corresponding online invoice.

Cancellation of the Commission Only service

The Partner can decide to cancel this agreement with ShortStayApartment.com at any moment. The cancellation must be communicated to ShortStayApartment.com by means of an email to the address admin@shortstayapartment.com.

ShortStayApartment.com will confirm its receipt and will deactivate the publication of the apartments/villas managed by the Partner within 2 working days from the cancellation request. In case of the cancellation of this agreement, ShortStayApartment.com will be due the commissions on the total amount of the enquiries confirmed by the Partner up to the date of the Cancellation Request.

Responsibility towards the User

Whatever responsibilities towards the User as a result of this agreement will be solely the charge of the Partner, as ShortStayApartment.com will act as a mere service of advertising space with which the Partner is free to present their accommodation offer.

Personal Information

ShortStayApartment.com forwards the information provided by the Users to the Partner exclusively for the aims specified in the scope of this agreement and always with the prior consent of the User. The Users will be informed about their personal data modification or cancellation methods and about all the other legal faculties that rule the subject.

The Partner is obliged to use this data solely and exclusively with the aims intended with this agreement, the information cannot be used for other purposes.
In case of a declined booking, or at the User’s request, the Partner must immediately delete any corresponding personal data, and will be solely responsible should this obligation not be adhered to.

Copyright

ShortStayApartment.com will not redistribute, use or share on third parties websites or publications any part of the listing material provided by the Partner unless directly controlled by ShortStayApartment.com. The listing material, i.e. photos and descriptions, will solely be published on www.shortstayapartment.com and its directly controlled pages with the purpose of promoting and marketing them for the benefit of the Partner. ShortStayApartment.com cannot be responsible if exposure is received from third parties covering www.shortstayapartment.com without prior knowledge.

Confidenciality

Both parties recognise that each has access to certain information which is not within the public domain and is therefore regarded as confidential, and property of the other party (Confidential Information). Included within this Confidential Information are sensitive data related to the development of the business activity, marketing information and techniques that one party reveals to the other, such as the BackOffice, client listings, sales information, material obtained by accessing the protected areas of the website, such as passwords, etc. Each party agrees that when such Confidential Information is presented to the other, the party in question will protect this Confidential Information against unauthorised exposure by putting in place such procedures and practices deemed necessary and will not use this Confidential Information (except in cases specifically authorised in this agreement) without the express permission and consent, in writing, of the other party.
